Terms of Use
Last updated: October 13, 2026
1. Provider and scope
These terms apply to your use of the Vibey app (the "App"). The provider is Niklas Rachow, Bauernweg 17, 19071 Dalberg-Wendelstorf, Germany, email: [email protected] ("we", "us").
Apple's Licensed Application End User License Agreement (Standard EULA) also applies to your license to use the App from the App Store. How we handle your data is described in our Privacy Policy.
2. What Vibey does
Vibey lets you edit your photos with AI effects, place yourself into new scenes with templates and edit photos with free filters. AI images are created by an AI model. Results therefore differ every time and may contain inaccuracies, for example in facial features, hands, text or background details. We do not guarantee that a result will match a particular outcome or that you will like it.
We aim for high availability but cannot guarantee that the App will always work without interruption, for example during maintenance, outages at our providers or periods of high demand.
3. Minimum age
You must be at least 13 years old to use Vibey. If you are a minor, you need the consent of your parent or legal guardian for purchases.
4. Vibey Pro (subscription)
What's included. Vibey Pro lets you use AI effects and templates. Currently up to 8 AI images per day are included. Unused images expire at the end of the day. Failed requests do not count.
Term and prices. The subscription is available weekly or monthly. The prices shown in the App Store before purchase apply, including VAT. An introductory offer (for example a reduced price for the first week) is only available to new subscribers and only if it is shown to you at purchase.
Automatic renewal. Your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Payment is charged to your Apple ID when you confirm the purchase; renewals are charged within 24 hours before the end of the period.
Cancellation. You cancel in your Apple ID settings under "Subscriptions". You can keep using Vibey Pro until the end of the paid period.
Billing, withdrawal and refunds. Apple is the seller in the App Store. Payments, withdrawals and refunds are therefore handled by Apple under Apple's terms. You can request a refund at reportaproblem.apple.com.
Changes to the offering. We may develop Vibey Pro further, for example by adding new effects or replacing individual effects. Price changes for existing subscriptions only take effect at the next renewal and only under Apple's rules, which inform you in advance.
5. Your photos and results
Your rights. You keep all rights to your photos. You only grant us the right to process your photos and pass them to our service providers to the extent necessary to create the result you asked for.
Results. You may use, share and publish the images you create privately and on your own social media channels. We claim no rights to them. Please note that AI results are often not protected by copyright under current law and that similar results may be created for other users.
Templates. The template photos in the App are protected by copyright. You may only use them within the App and may not download or otherwise use them.
Labeling. If you publish realistic AI images, you are responsible for labeling them where the law or the rules of the platform require it.
6. What is not allowed
You may not use Vibey to
- edit or publish photos of other people without their consent, in particular of children and teenagers without their parents' consent,
- create nude images, sexual content or sexualized depictions, and never in any form involving minors,
- deceive, harass, expose, blackmail or impersonate other people,
- create content that glorifies violence, incites hatred or infringes personality rights, copyrights or other rights of third parties,
- break any applicable law.
You also may not use the App in an automated way, reverse engineer it except where the law expressly allows this, or circumvent or overload our servers or protections such as the daily limit.
We and our providers may automatically reject requests that violate these rules or the policies of the AI providers. For serious or repeated violations, we may block AI features for your device.
7. Responsibility for content
You are responsible for the photos you upload and for what you do with the results. If you culpably violate these terms and third parties bring claims against us as a result, you will indemnify us against those claims, including reasonable legal defense costs.
8. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.
For slight negligence, we are only liable for breach of an essential contractual obligation, meaning an obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose fulfillment you may regularly rely. In that case, our liability is limited to the foreseeable damage typical for the contract.
Otherwise, liability is excluded. Statutory warranty rights remain unaffected.
9. Apple-specific terms
- These terms are between you and us only, not with Apple. We alone are responsible for the App and its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- We, not Apple, are responsible for addressing any claims by you or third parties relating to the App (for example product liability, failure to meet legal or regulatory requirements, consumer protection or privacy).
- If a third party claims that the App infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the App, for example your mobile carrier agreement.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, have the right to enforce them against you.
10. Changes to these terms
We may change these terms for a valid reason, such as new features, changes in the law or Apple requirements. We will inform you of material changes in the App in good time. Services already paid for will not change to your disadvantage.
11. Governing law and disputes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another country, you keep the protection of the mandatory laws of that country.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
If any provision of these terms is invalid, the remaining provisions remain in effect. If the German and English versions differ, the German version prevails.
